Terms of Service

By accessing or using the VehicleMarkt platform ("Platform"), including our website, mobile applications, and all related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Services. These Terms constitute a legally binding agreement between you ("User", "you", or "your") and VehicleMarkt ("we", "us", or "our"). We may update these Terms from time to time, and your continued use of the Services after any changes constitutes acceptance of the revised Terms.

To use our Services, you must: • Be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. • Have the legal capacity to enter into a binding agreement. • Not be prohibited from using the Services under applicable law. • If registering on behalf of a business entity, have the authority to bind that entity to these Terms. By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service, terminate accounts, or cancel transactions at our sole discretion if we reasonably believe you do not meet these requirements.

When you create an account on VehicleMarkt, you agree to: • Provide accurate, current, and complete information during the registration process. • Maintain and promptly update your account information to keep it accurate and complete. • Maintain the security and confidentiality of your login credentials. • Accept responsibility for all activities that occur under your account. • Notify us immediately of any unauthorised use of your account or any other breach of security. You may not transfer your account to any other person or entity without our prior written consent. We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, fraudulent activity, or extended periods of inactivity.

VehicleMarkt allows users to create listings for commercial vehicles, spare parts, and related products. When creating a listing or posting any content on the Platform, you agree that: • All information provided is accurate, truthful, and not misleading. • You have the legal right to sell the listed item and full authority to transfer ownership. • Listings must not contain false, deceptive, or fraudulent information about the condition, specifications, history, or provenance of a vehicle or part. • Images must accurately represent the item being sold and must be your own photographs or images you have the right to use. • You will not post duplicate listings for the same item. • All listed prices are genuine and reflect the actual asking price. We reserve the right to remove any listing or content that violates these Terms, without prior notice. User-generated content remains the responsibility of the user who posted it. By posting content on VehicleMarkt, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content in connection with the operation of the Platform.

VehicleMarkt serves as a marketplace platform that facilitates connections between buyers and sellers. We are not a party to any transaction between users. As such: • All transactions are conducted directly between the buyer and the seller. • VehicleMarkt does not guarantee the quality, safety, legality, or accuracy of any listing. • VehicleMarkt does not guarantee that a buyer or seller will complete a transaction. • Users are solely responsible for complying with all applicable laws and regulations in their jurisdiction regarding the purchase, sale, import, export, and registration of vehicles and parts. • Payment terms, shipping arrangements, and all other transaction details are agreed upon between the buyer and seller. • Users are responsible for conducting their own due diligence before entering into any transaction, including verifying vehicle history, condition, and legal status. Any disputes arising from transactions must be resolved directly between the parties involved. VehicleMarkt may, at its discretion, assist in dispute resolution but is under no obligation to do so.

You agree not to engage in any of the following prohibited activities: • Listing stolen, counterfeit, or illegally obtained vehicles or parts. • Posting false, misleading, or fraudulent listings or information. • Manipulating prices, feedback, or ratings. • Harvesting, scraping, or collecting user data without consent. • Using the Platform to distribute spam, malware, or other harmful content. • Circumventing or attempting to circumvent any security measures of the Platform. • Impersonating any person or entity, or falsely stating or misrepresenting your affiliation. • Using the Platform for money laundering, terrorist financing, or any other illegal activity. • Interfering with or disrupting the Platform's infrastructure or other users' access. • Engaging in any activity that could damage, disable, or impair the Platform. • Attempting to gain unauthorised access to any portion of the Platform or its systems. • Using automated systems (bots, scrapers, crawlers) to access the Platform without our express written permission. Violation of these prohibitions may result in immediate account suspension or termination, and may be reported to the relevant law enforcement authorities.

All content, features, functionality, design, text, graphics, logos, icons, images, software, and other materials on the Platform (collectively, "Platform Content") are owned by VehicleMarkt or its licensors and are protected by international copyright, trademark, patent, and other intellectual property laws. You may not: • Copy, modify, distribute, sell, or lease any part of the Platform Content. • Reverse engineer or attempt to extract the source code of any software used in the Platform. • Use our trademarks, logos, or brand names without our prior written consent. • Frame or mirror any portion of the Platform on any other website or service. The VehicleMarkt name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of VehicleMarkt. You must not use such marks without our prior written permission.

To the maximum extent permitted by applicable law: THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. VehicleMarkt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from: • Your use of or inability to use the Platform. • Any conduct or content of any third party on the Platform. • Any content obtained from the Platform. • Unauthorised access, use, or alteration of your transmissions or content. • Any transaction entered into between users of the Platform. • The condition, legality, or fitness of any vehicle or part listed on the Platform. Our total aggregate liability to you for all claims arising out of or relating to the use of the Services shall not exceed the amount you have paid to VehicleMarkt in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.

You agree to indemnify, defend, and hold harmless VehicleMarkt, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from: • Your use of the Platform or Services. • Your violation of these Terms. • Your violation of any third party's rights, including intellectual property rights. • Any content you post or submit through the Platform. • Any transaction you enter into with another user of the Platform. • Your violation of any applicable law, rule, or regulation. This indemnification obligation will survive the termination of your account and these Terms.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to: • Breach of these Terms. • Fraudulent, abusive, or illegal activity. • Extended periods of inactivity. • At our sole discretion, for any other reason. Upon termination: • Your right to use the Services will immediately cease. • All licences and rights granted to you under these Terms will immediately terminate. • We may delete your account data, listings, and content, subject to our data retention obligations under applicable law. • Any outstanding obligations or liabilities incurred prior to termination shall survive. You may terminate your account at any time by contacting us or using the account deletion feature, where available. Termination does not relieve you of any obligations incurred prior to termination.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall first be subject to good-faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of England and Wales. Notwithstanding the foregoing, VehicleMarkt may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the Platform or by other means (such as email notification) at least thirty (30) days before the changes take effect. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services and may request deletion of your account. We encourage you to review these Terms periodically to stay informed of any updates. The "Last updated" date at the top of this page indicates when these Terms were last revised.
